2. Scope and acceptance of these terms
These terms apply to services provided under the XMobility brand and to the contract between the Service Provider and the customer or passenger.
By finalising the booking, the customer confirms that they have read and accepted these terms before entering into the contract. Where a separate written agreement differs from these terms, that agreement takes precedence to the extent of the difference.
3. Scope of services
The Service Provider offers the following passenger transport services:
- taxi services in Szeged and the surrounding area;
- domestic and international door-to-door transfers;
- wedding guest transfers by minibus.
The vehicle, route, departure time, passenger count and other conditions are specified in the booking confirmation or individual quote. The Service Provider may use appropriately authorised subcontractors and is responsible for them as required by law.
4. Booking and formation of the contract
Bookings may be requested by phone, email or another contact channel made available by the Service Provider. Submitting a booking request does not in itself constitute acceptance.
The contract is formed when the Service Provider expressly confirms the booking verbally or in writing and the parties agree on at least the departure point, destination, time, passenger count and fare or method of calculating it.
The customer must provide accurate contact details and disclose all circumstances relevant to the service, including the need for child seats, oversized luggage, mobility aids or other special requirements.
5. Prices and payment terms
Current indicative prices are published on the website. Transfer prices are per person unless the quote or price list states otherwise. The final amount payable is specified in the booking confirmation or individual quote.
Advance booking deadline and applicable prices
If the time between receipt of the booking request and the planned departure is at least 12 hours, the price or calculation method published on the website for that route and service when the request is received applies, subject to the price-list conditions. Acceptance still requires the Service Provider’s confirmation.
If the time remaining until the planned departure is no at least 12 hours, the request is assessed individually. Depending on vehicle and seat availability and the arrangements needed for the journey, the Service Provider may offer an individual quote including a surcharge on the published price, or decline the booking request.
The Service Provider states any surcharge and the total payable in writing before the booking is finalised. A booking with a surcharge is concluded only with the customer’s express agreement; submitting the request alone does not constitute acceptance of a surcharge.
The deadline is calculated in elapsed hours from receipt of the request to the planned departure. Published prices and price-list conditions still apply to a request received exactly 12 hours before departure. An already confirmed booking may not be increased in price or declined solely because the time remaining until departure later falls below 12 hours.
Payment can be made in cash or by bank card. Unless otherwise agreed, payment is due when the service is completed.
Changes to the route, passenger count, duration, special requirements or changes requested by the customer may affect the price. Where possible, the Service Provider informs the customer before performing the service.
6. Cancellation and changes
The customer may cancel the booking free of charge at least 72 hours before the agreed start of the service.
For cancellation within 72 hours before the start, the customer must pay 50% of the agreed service price.
Changes are subject to availability. If a change materially affects the arrangements for the service, the Service Provider may issue a new quote.
7. Waiting charges and flight delays
From the agreed pick-up time, the first 10 minutes of waiting are free.
After that, each started 10-minute period incurs a charge of 1,000 HUF. Waiting time runs from notification that the Service Provider or vehicle has arrived, but no earlier than the agreed pick-up time.
Airport pickup – 30-minute flight delay
For airport pickups, the Provider will accommodate a flight delay of up to 30 minutes relative to the scheduled arrival time of the flight recorded in the booking. No surcharge applies solely for a flight delay within this period.
If the flight delay exceeds 30 minutes, the originally agreed pickup time cannot be guaranteed. Depending on vehicle availability and already confirmed trips, passenger pickup may be rescheduled to a later time, and a surcharge may apply for additional waiting or reorganising the transfer.
The Provider will inform the customer in advance of the expected new pickup time and the exact amount of any surcharge. A surcharge may only be charged with the customer’s express acceptance; a flight delay does not itself constitute acceptance of a surcharge.
The 30-minute rule above concerns flight delays. Waiting for the passenger at the pickup point remains subject to the general rule providing the first 10 minutes free of charge, measured from the newly agreed pickup time if it has changed due to a flight delay. No general waiting charge applies to the first 30 minutes of flight delay covered free of charge; the same waiting period cannot incur both a surcharge and a waiting charge.
8. Obligations of customers and passengers
- be fit to travel and ready at the agreed time;
- comply with road-safety requirements and the driver’s lawful instructions;
- not endanger the vehicle, driver, other passengers or road safety;
- provide advance information about luggage and any special characteristics;
- compensate for proven damage they cause.
The Service Provider may refuse or stop the journey if a passenger’s behaviour endangers safe performance or breaches the law.
9. Performance, delays and liability
The Service Provider seeks to keep to the agreed time and route. Journey times may be affected by traffic and weather conditions.
Unforeseeable traffic and weather disruptions
The Service Provider is not liable for damages arising from delays and their consequences caused by unforeseeable traffic congestion, road accidents along the route outside its control or unforeseeable exceptional weather, provided it proves that the obstacle was unforeseeable when the contract was concluded, was outside its control, and that reasonable measures could not have avoided the obstacle or prevented the damage.
Ordinary, foreseeable congestion alone does not establish exemption from liability. The Service Provider informs the customer of delays as soon as possible and takes the measures reasonably expected to mitigate the consequences.
Departure must be agreed with sufficient time in reserve to catch a flight or train or attend an event. The above provision does not exclude liability for intentional breach of contract or harm to life, physical integrity or health, and does not affect mandatory consumer rights. Otherwise, liability is governed by the Hungarian Civil Code.
10. Complaints and legal remedies
Submitting a complaint
Phone: +36 30 731 9270
Email: xmobilitykft@gmail.com
Postal address: the Service Provider’s registered office in section 1 of these terms.
The Service Provider examines verbal complaints immediately where possible. Written complaints receive a substantive written response within 30 days of receipt.
Customers acting as consumers may refer consumer disputes to the conciliation body competent for their place of residence or stay. The Service Provider cooperates with the conciliation procedure as required by law. Current contact details of the conciliation bodies are available at bekeltetes.hu.
The parties seek to settle disputes amicably. If this is unsuccessful, the dispute is subject to the competent Hungarian court with jurisdiction.
11. Final provisions
Matters not addressed in these terms are governed by Hungarian law, in particular the Civil Code, consumer protection legislation, electronic commerce rules and provisions governing distance contracts with consumers.
The Service Provider may amend these terms for the future. Amendments apply from the effective date stated on the website. Previously confirmed bookings remain subject to the terms effective at the time of booking unless a change is required by law.
